刑事诉讼

辩护律师的职责：根据事实和法律，提出犯罪嫌疑人、被告人无罪、罪轻或者减轻、免除其刑事责任的材料和意见，维护犯罪嫌疑人、被告人的诉讼权利和其他合法权益。《刑事诉讼法》第37条。

      刑事法律基本原则：打击犯罪和保障人权并重
      【罪刑法定】法律明文规定为犯罪行为的，依照法律定罪处刑；法律没有明文规定为犯罪行为的，不得定罪处刑。
      【适用刑法人人平等】对任何人犯罪，在适用法律上一律平等。不允许任何人有超越法律的特权。
      【责刑相适应】刑罚的轻重，应当与犯罪分子所犯罪行和承担的刑事责任相适应。

Duties of Defense Counsel: To present evidence and arguments that establish the innocence of the criminal suspect or defendant, mitigate or reduce the severity of the offense, and exempt them from criminal liability, in accordance with the facts and the law, while safeguarding their litigation rights and other legitimate interests. Article 37 of the Criminal Procedure Law.

Basic Principles of Criminal Law: Combating crime while safeguarding human rights

【Legality of Crimes and Punishments】If an act is explicitly defined as a crime by law, the offender shall be convicted and punished in accordance with the law; if an act is not explicitly defined as a crime by law, the offender shall not be convicted or punished.

【Equal Application of Criminal Law to All】In the application of the law, all individuals who commit crimes shall be treated equally. No person shall be allowed to have privileges that go beyond the law.

【Proportionality of Punishment】The severity of a punishment shall correspond to the criminal conduct committed by the offender and the criminal responsibility they bear.

忠实于法律和事实真相，保护国家、集体和公民的合法权益，认真履行职责、清正廉洁，恪守律师工作纪律和职业道德，保守在执业活动中知悉的国家秘密和当事人的商业秘密，不泄露当事人的隐私。

建立民事诉讼律师调查令制度，律师持委托书、律师事务所介绍信、律师执业证可以依法向工商、公安、海关、金融、不动产登记等部门调查核实有关情况，相关部门应当依照有关规定给予配合。

Establishing a system of lawyer’s investigative orders in civil litigation, lawyers, with their power of attorney, introduction letter from law firms, and lawyer’s practicing certificate, may lawfully investigate and verify relevant information from departments such as industry and commerce, public security, customs, finance, and real estate registration, and the relevant departments shall cooperate in accordance with relevant regulations.

Basic Principles of Civil Law: Equality, voluntariness, fairness, good faith, public order and customs, and environmental protection.
